Scope

The use of these web pages offered by Interelectronix e.K and/or its subsidiaries ("Interelectronix") (hereinafter referred to as the "Interelectronixwebsite") is only permitted on the basis of these terms and conditions. These General Terms and Conditions of Use may be supplemented, modified or replaced in individual cases by further conditions, e.g. for the purchase of products and/or services. By logging in, or, if a separate log-in is not required, by starting use, the validity of these Terms of Use in their current version is accepted.

If, when using the Interelectronixwebsite, the user acts as or for a company, i.e. in the exercise of a commercial or independent professional activity, or for a public corporation, § 312e para. 1 sentence 1 nos. 1 - 3 of the German Civil Code does not apply.

In the case of web offers aimed at companies or public corporations, the respective company or corporation is represented by the user and must be attributable to his actions and knowledge.

Performances


Interelectronix provides certain information and software, including documentation, if applicable, for retrieval or download on the Interelectronixwebsite.

Interelectronix is entitled to discontinue the operation of the Interelectronixwebsite in whole or in part at any time. Due to the nature of the Internet and computer systems, Interelectronix does not guarantee the uninterrupted availability of the Interelectronixwebsite.

Registration, Password

Some pages of the Interelectronixwebsite may be password protected. In the interest of the security of business transactions, access to these pages is only possible for registered users. There is no entitlement to registration by Interelectronix . In particular, Interelectronix reserves the right to make previously freely accessible websites subject to registration. Interelectronix is entitled at any time to revoke the access authorization by blocking the access data without the need to give reasons, in particular if the user has provided false information for registration, has violated these terms and conditions or his duty of care in handling the access data, has violated applicable law when accessing or using the Interelectronixwebsite or has not used the Interelectronixwebsite for a longer period of time has used.

If registration is planned, the user is obliged to provide truthful information for registration and to inform Interelectronix immediately (if provided: online) in the event of any subsequent changes. The user will ensure that he receives the e-mails that are sent to the e-mail address provided by him.

After successful registration, the user will receive a user name and password (hereinafter also referred to as "user data"). Upon initial access, the user will change the password provided by Interelectronix to a password known only to him. The user data enables the user to view and change his data or, if necessary, to revoke or extend his consent to data processing.

The user shall ensure that the user data is not accessible to third parties and shall be liable for all orders and other activities carried out under the user data. After each use, the password-protected area must be left. If the user becomes aware that third parties are misusing the user data, he is obliged to inform Interelectronix immediately in writing, if necessary in advance by simple email.

Upon receipt of the notification in accordance with Section 3.4, Interelectronix will block access to the password-protected area with this user data. The block can only be lifted after a separate application by the user at Interelectronix or after new registration.

The user can request the deletion of his registration in writing at any time, provided that the deletion does not conflict with the processing of ongoing contractual relationships. In this case, Interelectronix will delete all user data and all other stored personal data of the user as soon as they are no longer needed.

Rights of use to information, software and documentation

The use of the information, software and documentation made available on the Interelectronixwebsite is subject to these terms and conditions or, in the case of updates to information, software or documentation, to the relevant license terms previously agreed with Interelectronix . Separately agreed license terms, e.g. when downloading software, take precedence over these terms.

Interelectronix grants the user a non-exclusive and non-transferable right to use the information, software and documentation provided on the Interelectronixwebsite to the extent agreed or, if nothing has been agreed, to the extent that it corresponds to the purpose pursued by Interelectronix in making it available and making it available.

Software is provided free of charge in machine-readable form. There is no entitlement to the surrender of the source code. Excluded are source codes of open source software, whose license terms, which take precedence over these conditions when distributing open source software, prescribe the release of the source code. In this case, Interelectronix will make the source code available for reimbursement of costs.

Neither information, software nor documentation may be distributed, rented or otherwise made available by the user to third parties at any time. Unless otherwise permitted by mandatory legal regulations, the user may not modify, reverse engineer or translate the software or its documentation, nor may he remove any part of it. The user may make a backup copy of the software if this copy is necessary to secure future use on the basis of these Terms of Use.

The information, software and documentation are protected by copyright laws as well as international copyright treaties and other intellectual property laws and agreements. The user shall observe these rights, in particular shall not remove alphanumeric identifiers, trademarks and copyright notices from the information, software, documentation or copies thereof.

Sections 69a et seq. of the Copyright Act remain unaffected.

Intellectual property

Notwithstanding the special provisions in Section 4 of these Terms of Use, information, brand names and other contents of the Interelectronixwebsite may not be changed, copied, reproduced, sold, rented, used, supplemented or otherwise exploited in any other way without the prior written consent of Interelectronix .

Apart from the rights of use or other rights expressly granted herein, the user is not granted any further rights of any kind, in particular to the company name and industrial property rights, such as patents, utility models or trademarks, nor is Interelectronix any corresponding obligation to grant such rights.

Insofar as the user deposits ideas and suggestions on the Interelectronixwebsites, Interelectronix may use them free of charge for the development, improvement and distribution of the products from its portfolio.

Obligations of the user

When using the Interelectronixwebsite, the user must not:

  • cause harm to persons, especially minors, or violate their personal rights;

  • violate common decency with his usage behavior;

  • violate industrial property rights and copyrights or other property rights;

  • transmit content with viruses, so-called Trojan horses or other programming that can damage software;

  • enter, store or send hyperlinks or content to which he is not authorized, in particular if these hyperlinks or content violate confidentiality obligations or are illegal; or

  • Disseminate advertising or unsolicited e-mails (so-called "spam") or inaccurate warnings of viruses, malfunctions and the like, or solicit participation in sweepstakes, pyramid schemes, chain letters, pyramid schemes and similar actions.

Interelectronix may block access to the Interelectronixwebsite at any time, in particular if the user violates his obligations under these conditions.

Hyperlinks

The Interelectronixwebsite may contain hyperlinks to third-party websites. Interelectronix assumes no responsibility for the content of these websites nor does Interelectronix adopt these websites and their contents as its own, as Interelectronix does not control the linked information and is not responsible for the content and information provided there. Their use is at the user's own risk.

Liability for defects of title and quality

Insofar as information, software or documentation is provided free of charge, liability for material defects and defects of title of the information, software and documentation, in particular for their correctness, freedom from errors, freedom from third-party property rights and copyrights, completeness and/or usability - except in the case of intent or fraudulent intent - is excluded.

The information on the Interelectronixwebsite may contain specifications or general descriptions of technical possibilities of products, which may not always be available in individual cases (e.g. due to product changes). The desired performance characteristics of the products must therefore be agreed on a case-by-case basis at the time of purchase.

Other liability, viruses

The liability of Interelectronix for material defects and defects of title shall be governed by the provisions of Section 8 of these Terms of Use. In all other respects, any liability on the part of Interelectronix is excluded, unless liability is mandatory, e.g. under the Product Liability Act, due to intent, gross negligence, injury to life, limb or health, due to the assumption of a quality guarantee, due to fraudulent concealment of a defect or due to the breach of essential contractual obligations. However, damages due to breach of essential contractual obligations shall be limited to the foreseeable damage typical for the contract, unless there is intent or gross negligence.

Although Interelectronix makes every effort to keep the Interelectronixwebsite free of viruses, Interelectronix does not guarantee that it is virus-free. Before downloading information, software and documentation, the user shall ensure appropriate security measures and virus scanners for his own protection and to prevent viruses on the Interelectronixwebsite.

A change in the burden of proof to the detriment of the user is not associated with the above provisions in sections 9.1 and 9.2.

Compliance with export control regulations

When passing on the information, software and documentation provided by INTERELECTRONIX to third parties, the user must comply with the applicable provisions of national and international (re-)export control law. In any case, he must comply with the (re-)export control regulations of the Federal Republic of Germany, the European Union and the United States of America in such a transfer.

Prior to such disclosure, the user shall in particular check and take appropriate measures to ensure that:

  • it does not violate an embargo imposed by the European Union, the United States of America and/or the United Nations by such disclosure to third parties or by providing other economic resources in connection with information, software and documentation provided by INTERELECTRONIX , also taking into account any restrictions on domestic business and any prohibitions on circumvention;
  • such information, software and documentation provided by INTERELECTRONIX are not intended for a prohibited or authorisation-related armaments, nuclear or weapon use, unless any necessary permits have been obtained;
  • the provisions of all relevant sanctions lists of the European Union and the United States of America regarding business transactions with companies, persons or organizations named therein are complied with.

If necessary to carry out export control checks by authorities or by INTERELECTRONIX , the user shall provide INTERELECTRONIX immediately upon request with all information about the final recipient, the final destination and the intended use of the information, software and documentation provided by INTERELECTRONIX as well as any export control restrictions applicable in this regard.

The user shall fully indemnify INTERELECTRONIX against all claims asserted by authorities or other third parties against INTERELECTRONIX due to the user's non-compliance with the above export control obligations and undertakes to compensate INTERELECTRONIX all damages and expenses incurred in this context, unless the user is not responsible for the breach of duty. This does not entail a reversal of the burden of proof.

The fulfillment of the contract on the part of INTERELECTRONIX is subject to the proviso that there are no obstacles to fulfillment due to national or international regulations of foreign trade law as well as no embargoes and/or other sanctions.

Privacy

When collecting, using and processing personal data of the user of the Interelectronixwebsite, Interelectronix observes the applicable data protection regulations and the InterelectronixPrivacy Policy, which can be accessed via hyperlinks on the Interelectronixwebsite and/or at www.Interelectronix.com can be viewed.

Ancillary Agreements, Place of Jurisdiction, Applicable Law

Ancillary agreements must be made in writing.

If the user is a merchant within the meaning of the German Commercial Code, the place of jurisdiction is Munich

The individual pages of the Interelectronixwebsite are operated and managed by Interelectronix e.K. and/or its subsidiaries. The pages take into account the requirements of the respective country in which the responsible company is based. Interelectronix assumes no responsibility for the fact that information, software and/or documentation from the Interelectronixwebsite may also be accessed or downloaded in locations outside the country concerned. If users access the Interelectronixwebsite from locations outside the country in question, they are solely responsible for compliance with the relevant regulations under the respective national law. Access to information, software and/or documentation on the Interelectronixwebsite from countries where such access is unlawful is not permitted. In this case, and if the user wishes to enter into a business relationship with Interelectronix , the user should contact Interelectronixrepresentatives in the respective country.

German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
